State Authorization Update: What's Happening and What Should You Do?

In 2010, the U.S. Department of Education (USDOE) released new "program integrity" regulations for federal financial aid. The State Authorization regulation required institutions offering distance or correspondence education to acquire authorization from any state in which it "operates." This authorization is required for institutions to legally serve students in that state and to maintain eligibility to provide those students with federal financial aid. In July 2011, the United States District Court for the District of Columbia struck down the distance education portion of the USDOE's 'state authorization' regulations, however the current understanding is that the USDOE will repeal and the regulation will be reinstated.

While the regulation was "vacated" by the United States District Court, the USDOE will likely reinstate the rule by appealing the decision or through other methods. Even without the federal regulation, state regulations predate the federal regulation and remain in effect. States with regulations expect that institutions already be in compliance with their regulations before serving any students in their state.

A few national initiatives are in the works to develop national reciprocity agreements which could minimize the requirements for institutions to seek approval in each state they serve students.
